Criminal drug charges do not simply involve drugs such as marijuana, cocaine, and meth (methamphetamine). Often these charges involve the illegal purchase (including “doctor shopping”), use, or sale of prescription drugs such as Oxycontin and Vicodin.

Doctors routinely hand out prescriptions for these narcotic pain killers without fully understanding the addiction that follows. People who have never been in trouble with the law can find themselves facing DUIs (often called DWI) and felony drug charges.

In some cases, drug offenses can be resolved under one of Georgia’s First Offender programs, also known as Conditional Discharge Statutes. This means that you will not go to jail and, if you satisfy probation, you can have the charge altered on your record. The legal term is “nolle prosequi.” Nolle prosequi is a Latin term meaning “we [the prosecution] shall no longer prosecute”.

In other cases, it may be possible to defeat the state’s charges. As your lawyer, we will examine every detail of the state’s case to determine if the state violated your constitutional rights. For example, if the search and seizure were illegal, the drug evidence can be suppressed and the case dismissed.
