What Is Drunk Driving?
The federal government pushes a .08 blood alcohol limit. Georgia and other states have adopted this limit in order to receive road taxes from the federal government. While .08 is the limit for regular DUI charges (known as DUI per se), you can be charged with a lesser violation, DUI less safe, even if you are below the limit.
DUI convictions are a moneymaker for municipalities and counties. Once you are stopped by police on suspicion of drunk driving, the state will look for a way to convict you. If your blood alcohol content is too low to charge you with DUI per se, the prosecutor may charge you with DUI less safe for failure to maintain your lane or reckless driving.
